Divorce Mediation Basics
Mediation is a type of alternative dispute resolution (or “ADR”) method, which can allow parties to resolve their family law case without going to trial. Mediation is a process conducted by a neutral third party, called a mediator. Keep in mind the mediator cannot give legal advice. The mediator’s goal is to help the parties develop an agreement on any issues in dispute. In divorce cases, this often means division of property and assets, custody, and creating a parenting plan. For many people, mediation can be a viable alternative to litigation.
Benefits of Mediation
There are several potential benefits of using mediation. Parties can obtain a divorce without going to trial, and mediation is often quicker and less expensive than litigation. The parties also have more control over both the process and the outcome, since a mediator does not actually decide the issues. After all, you and your spouse are in the best position to understand your family’s needs and ensure that your settlement agreement reflects them.
