If you and your child’s other parent are no longer together, there is a high degree of likelihood that someone is paying (or will be paying) child support to the other.
In Maryland, there are calculators to determine child support so long as the parent’s incomes fall within the “guidelines”. If you and your spouse combined make under $15,000 per month, the calculator will compute child support for you. If you are outside of the guidelines, there are the extrapolated guidelines that will compute the support.
There are two calculators: one for primary custody to one parent, and one with shared custody. The amount of time the child(ren) spends overnight (not daytimes) will determine what calculator is appropriate to determine the support.
Often a child support action will be part of a child custody action (or modification action). It is not a requirement. You may wish to opt not to file for child support with the child custody action. We can assist you in deciding as to which is best based upon your situation.
Here at BGS Law, LLC we can assist in calculating the support as well as the enforcement and collection if the payor is not making the required child support payments. If you are facing a contempt action for not paying your child support payments, or have issues with a driver’s license/passport, or any other infraction for lack of support, we can help address these concerns and actions.
